These Terms explain how you may use eWYKCars Trader, including listings, communications, escrow related transactions, inspections, shipping coordination, and dispute handling.
These Terms of Use, together with any policies referenced in them, govern your access to and use of the websites, applications, tools, and services operated by eWYKCars Trader (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
If you use the Services on behalf of a business or other entity, you represent that you have authority to bind that entity to these Terms. You are responsible for ensuring that all persons who access the Services through your account are aware of these Terms and comply with them.
The Services are intended for individuals who are at least 18 years of age and who can form legally binding contracts. You may not use the Services if you are prohibited from doing so by applicable law.
We may update the Services, these Terms, and referenced policies from time to time. Changes will be effective when posted, unless we state a different effective date. Your continued use of the Services after changes are posted means you accept the updated Terms.
To use certain features, you may need to create an account. You agree to provide accurate information and keep it current. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Our Services may allow users to post, view, and interact with listings for vehicles and related items. You are solely responsible for the accuracy and completeness of any information you submit, including pricing, availability, vehicle condition, and vehicle identification details such as VIN and title status.
We do not guarantee that a listing is accurate, that a seller will complete a sale, that a buyer will complete a purchase, or that any vehicle will meet your expectations. Any due diligence, inspection, and verification is your responsibility.
Certain transactions on eWYKCars Trader may use escrow style workflows, where funds are held pending completion of agreed steps. Transaction specific instructions, such as purchase price, fees, inspection timelines, shipping steps, and release conditions, may be displayed and confirmed during the checkout or transaction flow (the “Transaction Instructions”).
By starting or joining a transaction, you agree to follow the applicable Transaction Instructions. Where permitted by law and by the selected payment method, we may place holds, receive funds, release funds, or return funds based on the Transaction Instructions, verified status updates, and dispute outcomes. If there is a conflict between these Terms and Transaction Instructions for a specific transaction, the Transaction Instructions will control for that transaction.
If a transaction includes shipping or delivery, the parties are responsible for providing accurate delivery details, cooperating with scheduling, and following packaging, pickup, and handoff requirements. Estimated timelines may vary based on carrier availability, weather, routes, inspections, and other factors.
Where an inspection period applies, the buyer is responsible for performing inspection within the agreed time and providing acceptance or rejection within that window. If a rejection is permitted, return, storage, or dispute steps will follow the Transaction Instructions. Failure to act within the inspection window may be treated as acceptance where allowed by the Transaction Instructions and applicable law.
Fees and payment options, including card payments, bank transfers, and other methods, may vary by transaction amount, location, and risk signals. Any applicable fees will be disclosed before you confirm a transaction.
You are responsible for taxes, registration, title transfer costs, import duties, and any other governmental charges that may apply to your purchase or sale, unless the transaction instructions explicitly state otherwise.
You may not use the Services for unlawful purposes or in a way that violates these Terms. Without limiting the above, you agree not to:
To protect users and comply with applicable requirements, we may request additional information to verify identity, ownership, or transaction legitimacy. This may include government issued identification, proof of address, proof of funds, vehicle documents, or other records as permitted by law. If you do not provide requested information, we may limit functionality, delay transactions, or decline to process a transaction.
You may be able to submit content such as listings, photos, messages, reviews, and documents (“User Content”). You retain ownership of your User Content, but you grant us a non exclusive, worldwide, royalty free license to host, store, reproduce, display, distribute, and otherwise use your User Content as necessary to operate, improve, and promote the Services, and to comply with legal obligations.
You represent that you have all rights necessary to submit your User Content, and that it is accurate and does not violate law or third party rights. We may remove or restrict content that violates these Terms or that we reasonably believe may cause harm.
The Services, including software, design, logos, and content provided by us, are owned by eWYKCars Trader or our licensors and are protected by applicable laws. Except as expressly permitted, you may not copy, modify, distribute, sell, reverse engineer, or create derivative works from the Services.
The Services may integrate or link to third party services, including payment providers, shipping carriers, inspection providers, analytics, and identity verification partners. Third party services are governed by their own terms and policies. We are not responsible for third party services, and your use of them is at your own risk.
By using the Services, you agree that we may communicate with you electronically, including by email, in app notifications, SMS where permitted, or posting notices within the Services. These communications may include transaction updates, security alerts, legal notices, and customer support messages.
To the fullest extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis. We disclaim all warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non infringement. We do not warrant that the Services will be uninterrupted, secure, or error free, or that listings, content, or communications will be accurate or complete.
To the fullest extent permitted by applicable law, eWYKCars Trader, its affiliates, and their officers, employees, agents, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising out of or related to your use of, or inability to use, the Services, even if advised of the possibility of such damages. Where liability cannot be excluded, our liability will be limited to the maximum extent permitted by law.
You agree to indemnify and hold harmless eWYKCars Trader, its affiliates, and their officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising from or related to your use of the Services, your User Content, your transactions, or your violation of these Terms or applicable law.
We may suspend or terminate access to the Services, or restrict certain features, at any time if we reasonably believe there is unauthorized activity, a security risk, fraud risk, a violation of these Terms, or other conduct that may harm users or the platform. Termination does not relieve you of obligations incurred prior to termination, including obligations related to active transactions, fees, and disputes.
If a dispute arises between users related to a transaction, you agree to follow the dispute steps described in the applicable Transaction Instructions, including providing requested documentation and responding within required timelines.
If a dispute involves funds held as part of an escrow style transaction, we may, as permitted by law and consistent with the Transaction Instructions, retain funds pending resolution, request additional verification, or take other actions reasonably necessary to protect users and comply with legal obligations. Nothing in these Terms prevents either party from pursuing rights available under applicable consumer protection laws.
These Terms are governed by applicable laws based on the Services provided and the parties involved. Certain jurisdictions provide mandatory consumer rights and protections, those rights remain in effect and are not limited by these Terms.
Our collection and use of personal information is described in our Privacy Policy. By using the Services, you acknowledge that you have reviewed it and understand how we handle personal information and communications.
